I also rejoice that our Medicare supplement benefit case has been remanded back to state superior court. The federal judge has provided a lengthy brief on this decision to not dismiss the case and instead to remand it back to state court. The Task Force with our lawyer will have to dissect the decision to understand the merits of the federal judges decision and how it affects both the plaintiffs (us) and the defendants (Piedmont). Skipping the judges detail the federal judge outlined why the case did not have standing in federal court and at the same time indicated that the federal court should not express an opinion concerning both parties positions in the case. This is a good Christmas present for our retirees and I hope you find some peace until the case reactivates in superior court.
